TERMS AND CONDItions

These terms and conditions govern the use of Poupa Energia.

Poupa Energia and all its contents are owned by the Logistics Operator for Change of Merchant (OLMC).

ADENE is the Energy Agency (ADENE) which is a Public Utility Collective, created by Decree-Law no. 223/2000, of 9 September, registered at the Commercial Registry of Lisbon, with the unique registration number and identification number of legal person 501618392, based at Avenida 5 de Outubro 208, 1050-065 Lisboa, which is responsible for the contents of Poupa Energia, available at http://poupaenergia.pt/, in the Play Store and App Store.

The use of Poupa Energia gives the visitor the status of user and implies acceptance as a “User”, and without any reservation, of the present general conditions of use, together with the particular conditions that, in each case, may be established , so the User must read them before browsing or using the Energy Portal.

By accessing or using Poupa Energia or downloading any material made available to it, the User expressly agrees and accepts to be bound by all the terms and conditions contained in these general conditions of use of Poupa Energia. If you do not agree with them, the User must not use Poupa Energia or download or subscribe to any material or service it contains.

Access to Poupa Energia is free and free, however limited to persons over 18 years of age, OLMC is not responsible for access by minors who are not duly authorized and / or supervised by parents and / or representatives of minors. When accessing Poupa Energia, the User declares to be over 18 years old or to have authorization from his parents and / or representatives for this purpose. The User acknowledges that the services provided by OLMC are aimed at persons over 18 and / or legal persons.

The User acknowledges and accepts that access to and use of Poupa Energia is his sole responsibility, committing himself to use Poupa Energia, its contents and services in accordance with the Law and in accordance with these general conditions.

OLMC will eliminate the content made available by third parties on Poupa Energia if it has effective knowledge that these are manifestly illegal or infringe the rights of third parties, or if it is ordered by court order or administrative order.

To the maximum extent permitted by law, OLMC may introduce new conditions of use through the respective publication in Poupa Energia and communication of such information to Users through the website, in order to be known by Users at the moment they access it and prior to a new use of the site. Consequently, the use of Poupa Energia by Users after the changes have been made and the respective notice is published on the website, will mean the Users’ acceptance of these modified general or particular conditions.

OLMC provides, through Poupa Energia, a service that allows the User (consumer) to identify which solutions on the market are best suited to their profile with a view to saving energy and costs.

The possible negotiations between Users and potential energy suppliers are the sole responsibility of the negotiating parties, and OLMC does not have any intervention or any responsibility in their definition.

INTELLECTUAL AND INDUSTRIAL PROPERTY

The content of Poupa Energia is protected by copyright and related rights, as well as by the right to industrial property, under Portuguese and European Union laws, and cannot be used outside the conditions allowed in the use of this page, without prior express consent OLMC.

The intellectual property rights of all the contents of Poupa Energia that are not aimed at external supply and consequently are not properly identified, belong to OLMC, including, by way of example, photographs, images, logos, trade names, drawings, sounds, bases data, software, flow diagrams, presentation, audio and video, trademarks and patents, icons or any other distinctive signs susceptible of industrial and commercial use, information, tools, graphics, images, graphics or texts.

Unless expressly authorized, the User may not reproduce, transform, modify, disassemble, reverse engineer, distribute, rent, provide, make available or allow access to the public, through any form of public communication of any of the elements referred to in the previous paragraph.

The User is only allowed to use the contents of Poupa Energia for personal use, obliging himself not to carry out, directly or indirectly, a commercial exploration of the materials, elements and information available through the website.

OLMC repudiates any responsibility for the usurpation and improper use of the elements mentioned above, except for the exceptions allowed by law, namely the right to quote, as long as its origin is clearly identified. The contents of this page may not be copied, altered or distributed, unless expressly authorized by OLMC.

OLMC reserves the right to temporarily interrupt or suspend, and without prior notice, access to Poupa Energia for as long as it deems necessary, for any technical, administrative, force majeure or other reasons that may arise and are not directly contemplated here.

OLMC may, at any time and without prior notice, change the presentation and configuration of the website

Any attempt to tamper with the contents or structure of the Portal and its attached means, or any other action that may cause damage and jeopardize the integrity of the system, may be subject to judicial proceedings.

The contents are updated to the present date. However, and given the interconnection with different entities that constitute a source of information for Poupa Energia, they may not always be up to date, despite the effort made regularly for this purpose. In this sense, OLMC is not responsible for any damage or loss, direct or indirect, suffered by any user, in relation to the information contained in this Portal whose currentness and correction is not verified by the User.

PERSONAL DATA

The User expressly acknowledges that, in order for OLMC to provide the services described in the Poupa Energia Portal, it needs to collect and process certain information from the User, including personal data.

Before making his personal data available to OLMC, the User must consult the conditions for the collection and treatment of his personal data, which are available for consultation in the Privacy Policy.

The Privacy Policy must be accepted prior to making your personal data available to OLMC. If you do not agree with its terms, you should not provide your personal data to OLMC. In this case, the User expressly acknowledges that the provision of the services indicated on the Poupa Energia Portal by OLMC may not be possible.

EXCLUSION OF WARRANTIES AND LIABILITY

OLMC does not, in general, control the use that Users and / or third parties make of the Poupa Energia Portal or the information and content eventually included therein by third parties, not guaranteeing that Users and / or third parties use the Poupa Energia Portal in accordance with the law, with the present general conditions, morals, good customs and public order. Thus, to the maximum extent permitted by law, OLMC is in no case responsible for the use that Users and / or third parties may make of the Poupa Energia Portal.

All information contained in the Poupa Energia Portal is provided to the User as presented and OLMC rejects all warranties, representations and links, express or implied, regarding the information accessed from or via other sites, to the extent permitted under the scope applicable jurisdiction.

The present general conditions do not prejudice the application of particular conditions that, eventually, may be agreed with the Users and that come to complete, alter and / or develop the present general conditions.

At no time and under any pretext, OLMC shall be responsible for any errors or omissions of any kind resulting from the information provided by it on the Poupa Energia Portal, damages of any kind, arising from any cause, including but not limited to emerging damages or loss of profits, or any other type of damage, tangible or intangible, in any way related to the use or performance of the information made available or accessed through the website, not verified by the User, except in case of intentional or gross negligence on the part of the User OLMC.

OLMC does not guarantee that the website will function correctly at all times in a fast, uninterrupted and error-free manner, nor that all errors are corrected. OTHER DISPOSITIONS

These general conditions are governed and interpreted in accordance with Portuguese law and the parties agree to submit to the exclusive jurisdiction of the Portuguese courts for the resolution of any disputes related to these general conditions.

If any part or provision of the present general conditions is considered null or invalid, the remaining provisions will remain in force, and their validity will not be affected. Such provision considered null or invalid must, however, be carried out to the maximum extent permitted by law.
